Supreme Court Keeps Title 42 Trump Immigration Policy in Place Until Case Is Heard

Nineteen states filed a lawsuit to keep Title 42 in place, due to concern that law enforcement, education and health care services will be unduly burdened. Title 42 may remain in place until the states' case is heard by SCOTUS sometime in February or March 2023. A decision is due by the end of June. SCOTUS made a statement that "the stay itself does not prevent the federal government from taking any action with respect to that policy." This means that the Biden administration still has the power and prerogative to discontinue the policy on its own if it so chooses.
