Update: CFS Fighting Monsanto in the Supreme Court!

As I understand it, the fantastic folks at CFS have already roundly pummeled Monsanto in the lower courts as follows:

1. Monsanto obtained its GMO alfalfa illegally, EPA environmental impact studies / statements neglected. Sales since then have been illegal.

2. Monsanto sales of GMO alfalfa completely halted by immediate injunction, pending compliance with 1.

3. GMO Alfalfa shall be increasingly regulated along stricter lines highly unfavorable to Monsanto (as opposed to de-regulated, as sought by Monsanto)

This story is in reference to Monsanto's supreme court appeal. As it turns out, they may have made a huge blunder, as they did not appeal point 3 (by mistake?). Therefore, even if the injunction is overturned, they accomplish nothing, as sale of the seeds is still now re-regulated with the same conditions that they have not met under point 1.
