2 Comments in Response to Arizona immigration law blocked: Governor plans swift appeal . Is block unconstitutional?
Arizona Governor Jan Brewer plans to swiftly appeal a judge's ruling blocking key components of Arizona's new state immigration law. The firework is on.
Here's the problem. The court blocked only key components of the Arizona immigration law that are disagreeable with the federal immigration law. This judicial impediment was not against the right of the state to protect Arizona citizens from illegal immigration as the Governor claims. The responsibility of protecting U.S. citizens -- not just Arizona citizens -- against illegal immigration belongs to the Federal Government as mandated by federal laws. The state may complement but cannot preempt the Federal Government of this legal and moral responsibility.
The bone of contention is not there. It is here: Is the Federal Government remised of this duty? No doubt about it. If it is, then the battle should be fought in Congress to amend the federal immigration law. It is not in Court … Arizona will lose there.
Incompetence of the Federal Government in the enforcement of federal immigration laws does not automatically confer the state the right to preempt federal laws or subrogate itself into that responsibility of protecting U.S. citizens from illegal immigration, be it in Arizona or in other states.
I am for the Governor’s passion to protect the citizens of Arizona. I love that state and my relatives live there happily for years. However, the Governor’s concerns should not be wrongly misinterpreted or misplaced, or shown in such a way that the public would suspect that it is all for political expediency. The wrong battle the Governor is currently fighting surely attracts a lot of tea and sympathy, but as usual, it is but political fireworks as the nation gears for the coming national election where the GOP’s deadliest warriors determined to defeat those donkeys in power, are behaving like attack dogs.
Jan Brewer should marry Joe Arpaio and go to Mexico on their honeymoon.
