You have the law of the people vs the law of the fast driver. The driver doesn't have to accept the summons. But if his driving is found guilty by the jury, the question becomes "Who is stronger?" --- The idea of the people is not to limit a guy in his freedom to drive. The people are only trying to protect their families and property. The driver is the aggressor, if only by threat. Hopefully the jury will remain friendly enough to use force in a gentle way - not to force the driver's car into the lake.
