The Government takes the position that it can search, seize, fold, spindle, etc., from the fact that the person in question has NOT YET entered the U.S. and is therefore not protected by the Constitution.  Once the person has been 'admitted' into the U.S. his Constitutional protections against search and seizure take effect.  Of course that only counts if the 'Government' really gives a K-K about Constitution rights.
