Dr. Jason Newsom railed against burgers, french fries, fried chicken and sweet tea in his campaign to promote better eating in a part of the country known as the Redneck Riviera. He might still be leading the charge if he had only left the doughnuts alone. A 38-year-old former Army doctor who served in Iraq, Newsom returned home to Panama City a few years ago to run the Bay County Health Department and launched a one-man war on obesity by posting sardonic warnings on an electronic sign outside: "Sweet Tea (equals) Liquid Sugar." "Hamburger (equals) Spare Tire." "French Fries (equals) Thunder Thighs." He also called out KFC by name to make people think twice about fried chicken. Then he parodied "America Runs on Dunkin'," the doughnut chain's slogan, with: "America Dies on Dunkin'."

HR 3394, The Health Information Protection Act, inhibits the FTC from acting against any entity for communicating the health benefits of its products unless the FTC presents "clear and convincing" evidence that those statements are false. In concordance with the Fifth Amendment, the burden of proof concerning an accusation of a false claim is to fall upon the accuser (FTC) to determine, with legitimate evidence, that a claim is false before demanding its removal. As it stands, the FTC has reversed the Fifth Amendment by preemptively and arbitrarily restraining communication without any evidence or reason while demanding that the accused party prove its claim to be true. HR 3394 will reinforce the already lawful Fifth Amendment that establishes the burden of proof upon the FTC to present a legitimate case before impeding any lawful communication. It will restore the freedom to communicate nutrient-disease health claims freely. Similarly to HR 3394, HR 3395, The Health Freedom

UPDATE: St. Louis County police say six people were arrested. Two of those were arrested on suspicion of assault, one of resisting arrest and three on suspicion of committing peace disturbances. Carnahan was gone when the ruckus started. Kenneth Gladney, a 38-year-old conservative activist from St. Louis, said he was attacked by some of those arrested as he handed out yellow flags with “Don't tread on me” printed on them. He spoke to the Post-Dispatch from the emergency room of the St. John's Mercy Medical Center, where he said he was waiting to be treated for injuries to his knee, back, elbow, shoulder and face that he suffered in the attack. Gladney, who is black, said one of his attackers, also a black man, used a racial slur against him before the attack started. “It just seems there's no freedom of speech without being attacked,” he said.

For the most part, hate-crime legislation is just a sop for politically influential interest groups -- yet another area in which liberals, traditionally sensitive to civil liberties issues, have chosen to mollify an entire population at the expense of the individual and endorse discredited reasoning about deterrence.

It is time to speak plainly for the good citizens and patriots of this nation who believe unbendingly in the Constitution of the United States of America. Though foreign governments may disarm their subjects, we will not go down that road. We will not disarm and see our freedoms stripped away. The lessons of history are numerous, clear, and bloody. A disarmed population inevitably becomes an enslaved population. A disarmed population is without power, reduced to childlike obedience to-and dependence upon - the organs of a parental state.
