"The Court should reimpose its order granting bail pending appeal, so Mr. Bannon is not forced to serve his entire sentence" before the full benches of the DC Circuit or Supreme Court "can hear his case on the merits," Attorneys Trent McCotter and Evan Corcoran wrote.

They also wrote that if bail isn't approved, "Mr. Bannon respectfully requests that the Court reduce his sentence (even a few days per conviction would suffice) and impose a period of supervised release (again, even a few days per conviction would suffice) so he can be eligible to utilize First Step Act credits."
