Suspending the Constitution in emergencies (if this is even really allowed), doesn't suspend your rights. The 9th Amendment doesn't give you your rights. It only expresses that you have always had your right, Constitution or not. The 9th Amendment: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." If law enforcement interferes with your rights when you don't have a contract with them, and you haven't harmed anyone, sue them. But above all, sue their bosses.
