Biden Regime Breaches the UN Charter, UN Host Country Agreement, and Vienna Convention

by Stephen Lendman

Hegemon USA long ago abandoned the rule of law in pursuit of its diabolical aim to control the world community of nations, its resources and populations — by brute force if lesser tactics fall short.

Its ruling regimes find new ways to define what imperial arrogance is all about.

In breach of the UN Charter, its Host Country Agreement, and Vienna Convention on Diplomatic Relations, the Biden regime expelled 27 Russian diplomats and their families last year for invented reasons.

No legitimate ones existed according to the rule of law.

By illegally annulling the accreditation of targeted individuals, they were "kicked out" of the US, Russia's envoy to the country, Anatoly Antonov, stressed, adding:

The Biden regime's hostile action belied its claim about "how carefully the US cherishes family traditions" and the rule of law.

"Almost nothing is changing."

The atmosphere (in the US) is…poisoned with Russophobia…in the media…Congress…" and the White House.

Bilateral relations have been in tatters for years by US war on Russia by other means with intent to demolish them altogether.

One shoe after another drops, the latest one on Monday.

Once again in breach of the UN Charter, the Host Country Agreement and Vienna Convention, the Biden regime declared 12 more Russian diplomats persona non grata.

Falsely calling them "intelligence operatives," they were ordered to leave Moscow's UN mission in NYC and the US by March 7.

Expulsion is based on phony claims of "engaging in espionage activities that are adverse to our national security (sic)."

The US mission's UN spokeswoman Olivia Dalton ignored the letter and spirit of how the how the UN HQ's host country is supposed to operate by falsely claiming that Monday's hostile action was "in accordance with the UN Headquarters Agreement (sic)."

In November 1947, the US entered into the UN Host Country Headquarters Agreement.

In August that year, Washington codified the agreement into federal law.

It stipulates clear US legal obligations as UN host country in NYC.

Article 11 of the agreement states:

"The federal, state or local authorities of the US shall not impose any impediments to transit to or from the headquarters district of:

(1) representatives of Members or officials of the UN, or of specialized agencies as defined in Article 57, paragraph 2, of the Charter, or the families of such representatives or officials."

Section 11 also prohibits host country USA from creating barriers for representatives of UN member States to travel to and from the headquarters district — or interfere with their diplomatic duties.

Section 12 of the agreement states:

"The provisions of Section 11 shall be applicable irrespective of the relations existing between the governments of the persons referred to in that section and the government of the US."

Section 13 states:

"Laws and regulations in force in the US regarding the entry of aliens shall not be applied in such a manner as to interfere with the privileges referred to in Section 11."

"When visas are required for persons referred to in that section, they shall be granted without charge and as promptly as possible."

Time and again, the US breached the letter and spirit of its legal obligations as host country for UN headquarters in NYC.

Its unlawful actions constitute just cause to relocate UN HQ elsewhere.

It should have been done long ago.

UN Charter Article 104 mandates the following:

"The Organization shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of its functions and the fulfillment of its purposes."

Article 105 states:

"1. The Organization shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the fulfillment of its purposes."

2. Representatives of the Members of the United Nations and officials of the Organization shall similarly enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Organization."

The Vienna Convention on Diplomatic Relations (1961) covers rights afforded to representatives of nations to perform their duties without coercion, harassment, or obstruction in nations where they're assigned.

In response to the Biden regime's latest affront to the rule of law, Russia's UN envoy Vassily Nebenzia said the following:

Ordered expulsion of 12 Russian diplomats from its UN mission was "another (in a long line of) hostile step(s)" by hegemon USA.

"Just received information" about it.

The expulsion order "grossly violate(s) the (UN) Host Country Agreement," adding:

Russia has many diplomats in the US whose visas weren't extended.

If they leave the country, they'll be barred from returning.

With Russian/US relations virtually ruptured, all its diplomats are at risk of expulsion, including Nebenzia if dominant Biden regime hardliners push things this far.
