At Arizona State University is the studio for Phoenix' PBS station KAET Ch8. A daily show called "Horizon" has been on for decades and features Michael Grant as the host. He is a local attorney that discusses local politics and events here in Arizona that tends to focus on the opinions of elected officials and the local newspaper reporters that are assigned a desk at the State Capitol building. Since the President of the Senate determines the conditions of use for the Senate Press Room you can imagine the ‘pro state’ reporting. Horizon is a publicly funded entity on a state University so taking a ‘Freedom’ position is rare but not unheard of.

Vote accuracy is one of those issues that they seem to give some time to on a regular but rare basis. Tonight will be interesting since representatives from the Secretary of State’s office and the Maricopa County Elections Department will be asked to comment on my recorded statements. The law passed to required a hand count to evaluate the accuracy of the election computers is not being implemented and my lawsuit pointed this out. The Secretary of State complied with the requirements of the law defined in my lawsuit but is preventing the enacting of the law using other methods (Not providing the require ‘Policy and Procedure Manual’ to the counties for the implementation of the law.

The hand count to check the accuracy of the election computers will never be implemented and my efforts have highlighted this. The passage of the legislation was a reaction to the demands of the people but its implementation was never going to be allowed.

The following FOIA (a state version of a Freedom of Information Request) is to highlight the continued effort to never see this law implemented.

This is an ARS 39-121.01 request for public information.

County Recorders across the state require changes to the Secretary of State ‘Policy and Procedures Manual’ in order to implement changes in election law due to the passage of Emergency Legislation (SB 1557) June 28th, 2006.

County Party Chairmen are prevented from providing the list of Hand Counters as provided by law due to County Elections not having instructions from the Secretary of State.

I am requesting examination of the changes to the instructions to the County Election Departments for each county in Arizona for the implementation of SB1557.

I will stop by the Secretary of State’s office today 08-23-2006.
